1. Acceptance of Terms
By accessing or using our junk removal services, including scheduling an appointment, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
2. Service Description
Austin Junk Removal provides residential and commercial junk removal services in the Austin, TX metropolitan area. Our services include:
- Furniture removal and hauling
- Appliance removal and disposal
- Yard waste and debris removal
- Estate cleanouts and downsizing assistance
- Construction debris removal
- General junk removal and hauling
3. Pricing and Payment
3.1 Estimates: Prices quoted by phone or online are estimates only. Final pricing is determined on-site based on the actual volume and type of items to be removed.
3.2 Volume-Based Pricing: We charge based on how much space your items take up in our truck. Our team will show you the items loaded in the truck before finalizing the price.
3.3 Payment: Payment is due upon completion of service. We accept cash, credit cards (Visa, MasterCard, American Express, Discover), and Venmo. A receipt will be provided upon request.
3.4 Minimum Charge: A minimum charge may apply for service calls. This will be communicated during the booking process.
4. Scheduling and Cancellations
4.1 Appointments: We offer same-day and next-day service based on availability. Appointment times are estimates, and we will provide a 2-hour arrival window.
4.2 Cancellations: You may cancel or reschedule your appointment at any time by calling us. We appreciate as much notice as possible. There are no cancellation fees.
4.3 Weather and Delays: In case of severe weather or unforeseen circumstances, we may need to reschedule your appointment. We will contact you as soon as possible to arrange an alternative time.
5. Items We Cannot Accept
For safety and legal reasons, we cannot accept the following items:
- Hazardous materials (paint, chemicals, asbestos, batteries, fuel)
- Medical waste or biohazards
- Radioactive materials
- Explosives or ammunition
- Items requiring special disposal permits
If you're unsure whether we can accept an item, please call us before booking.
6. Customer Responsibilities
You agree to:
- Provide accurate information about the items to be removed
- Ensure clear and safe access to the items for our crew
- Inform us of any hazardous materials or prohibited items
- Be present or authorize someone to be present during the service
- Move any fragile or valuable items away from the work area
7. Liability and Insurance
7.1 Insurance: We are fully insured for general liability.
7.2 Property Damage: While we take great care in removing items, we are not liable for pre-existing property damage or damage caused by normal wear and tear during the removal process.
7.3 Items Left Behind: Once items are removed from your property, they become our property. We are not responsible for items removed at your request.
8. Environmental Responsibility
We are committed to environmentally responsible disposal. We donate, recycle, and repurpose items whenever possible. Only items that cannot be donated or recycled are taken to licensed disposal facilities.
9. Limitation of Liability
To the fullest extent permitted by law, Austin Junk Removal shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our services. Our total liability for any claim shall not exceed the amount paid for the service in question.
10. Dispute Resolution
Any disputes arising from these Terms of Service or our services shall be resolved through binding arbitration in Travis County, Texas, under the rules of the American Arbitration Association. You agree to waive your right to a jury trial or to participate in a class action lawsuit.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes are posted constitutes acceptance of the modified terms.
12. Mobile Message Service Terms
By providing your phone number to Austin Junk Removal, you agree to receive recurring automated marketing and informational text (e.g., SMS and MMS) messages from us, including text messages that may be sent using an automatic telephone dialing system, to the mobile telephone number you provided.
- Consent: Consent to receive automated marketing text messages is not a condition of any purchase.
- Frequency: Message frequency will vary.
- Rates: Message and data rates may apply.
- Opt-Out: You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
- Help: If you are experiencing issues with the messaging program you can reply with the keyword "HELP" for more assistance, or you can get help directly at Junkremove@proton.me.
- Carriers: Carriers are not liable for delayed or undelivered messages.
13. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
